Collaborative
Divorce Lawyers have undergone specialist training where they
learn how to deal with conflict and emotion. While they are there to
advise their client, essentially, the agenda belongs to the parties,
and the lawyers simply “steer from behind” acknowledging that it is
their clients' lives' that they are dealing with and not their own.
This approach is so different to the traditional approach.
The communications between lawyers
are open and relationships build between the lawyers and their
clients in a different way because of this. There is a paradigm
shift from the clients and their solicitors taking up “positions” to
“considering interests”, from adversarial to co-operative. This is
totally different to the traditional approach.
Currently there is no Public Funding / Legal Aid available for
Collaborative Law.
